Capigo — Terms of Service

These Terms of Service ("Terms") govern your use of the Capigo mobile application (the "App") and related services provided by Capigo ("Capigo", "we", "us", or "our").

Please read these Terms carefully before using the App.

By downloading, accessing, or using Capigo, you agree to these Terms. If you do not agree to these Terms, you must not use the App.

1. Who provides Capigo

At the time these Terms were last updated, Capigo may be operated as an unregistered business activity under applicable Polish law. If the legal form or business registration details change, these Terms will be updated accordingly.

2. What Capigo does

Capigo is a mobile application designed to help users create, organize, and manage notes.

Depending on the features available in the App, Capigo may allow you to:

3. Eligibility and age

You must be at least 13 years old to use Capigo.

By using the App, you confirm that you meet this minimum age requirement.

Where applicable law imposes additional requirements regarding the use of digital services by minors or the processing of personal data relating to minors, those requirements continue to apply.

4. Your account

Certain features may require you to sign in using a supported authentication method. Depending on the version and configuration of the App, available methods may include Google Sign-In and email-and-password authentication.

You are responsible for:

You may use more than one account, provided that you do not use multiple accounts or other methods to abuse promotions, free allowances, purchases, or other features of Capigo.

We may take reasonable action where we detect abuse, fraud, manipulation, or attempts to circumvent usage limits or purchase controls.

5. Your notes and local data

5.1 Notes are stored locally

Capigo stores your notes and note-related content on your device.

Capigo does not provide a general cloud backup or synchronization service for your notes or attached files.

Your note content and attachment files are not stored on Capigo's servers. However, when you voluntarily use features involving external processing, such as AI-powered voice processing described in Section 7, audio recordings and related processing data may be transmitted to third-party service providers for the purpose of providing that feature.

You are responsible for maintaining any backup of your notes that you consider necessary.

5.2 Loss of local data

Because notes are stored locally, deleting the App, clearing its storage, resetting your device, or otherwise removing local App data may permanently delete notes and other locally stored content.

We are not responsible for restoring local data that has been deleted where no backup or recovery mechanism exists.

5.3 Export

Capigo may provide functionality allowing you to export certain note data.

Exports do not include the actual files attached to notes.

Where applicable, an export may include information referring to attachments, but not the attachment files themselves.

An export should therefore not be treated as a complete backup of all data stored in the App.

6. Attachments and uploaded content

You may attach files to notes subject to the technical limits of the App.

Capigo currently accepts files of any type, subject to the following limits:

You must not use Capigo in a way that violates applicable law or infringes the rights of others.

7. AI-powered voice processing and AI Uses

7.1 AI voice processing

Capigo may provide AI-powered voice processing features that can convert speech into text and assist with creating or organizing notes.

When you use AI-powered voice processing, your audio recording is transmitted to third-party service providers involved in transcription and AI processing. Those providers may process and retain submitted content in accordance with their own applicable terms, privacy policies, and service arrangements.

In particular, the transcription provider may process voice data using its own systems and policies, including for purposes described in its applicable documentation relating to service operation, safety, and improvement.

Further information about the processing of personal data, including the identity of relevant providers, is provided in the Privacy Policy.

7.2 Recording limits

Each voice recording submitted for AI processing is limited to a maximum duration of two minutes.

Recordings that exceed applicable technical limits, including duration or file size limits, may be rejected before AI processing begins.

7.3 AI Uses

Certain AI-powered features consume an available unit of usage ("AI Use").

Your available AI Uses are associated with your Capigo account.

AI Uses do not expire solely because time passes.

Unless otherwise required by law, AI Uses remain available until they are:

7.4 Reservation and restoration of AI Uses

To prevent concurrent requests from using the same available balance, an AI Use may be reserved when server-side processing begins.

Where processing fails on the server before a successful result is completed, the reserved AI Use is restored in the following situations:

An AI Use is not reserved where the request is rejected before processing begins, including where:

7.5 Situations outside server-side recovery

Once processing has progressed beyond the point at which the server can reliably reverse the reservation, an AI Use may not be restored even if you do not receive or save the final result.

This may occur, for example, where:

We may investigate technical failures and correct errors where reasonably possible, but we do not guarantee that every unsuccessful attempt can be automatically reversed.

7.6 AI output

AI-generated results may be inaccurate, incomplete, misleading, or unsuitable for your intended purpose.

You are responsible for reviewing AI-generated content before relying on it.

Capigo does not guarantee the accuracy, completeness, or suitability of AI-generated transcriptions, titles, categories, reminder dates, reminder times, or other generated results.

You should not rely on Capigo as a substitute for professional, medical, legal, financial, emergency, or other specialist advice.

8. Purchases and paid AI Uses

8.1 Google Play Billing

Purchases of AI Uses made through the Android version of Capigo are processed through Google Play Billing.

Google Play may apply its own terms, payment procedures, and policies to purchases.

We do not receive or store your payment card details.

8.2 Purchase verification

Purchases may be verified before AI Uses are added to your account.

We may refuse, delay, reverse, or correct a purchase-related balance adjustment where reasonably necessary to:

Refund requests may be subject to Google Play procedures and applicable law.

Where Google Play directs you to contact us regarding a refund, we will consider the request in accordance with applicable law and mandatory consumer protection requirements.

Nothing in these Terms limits any consumer rights that cannot lawfully be excluded.

8.4 Refunded or invalidated purchases

If a purchase is refunded, revoked, cancelled, charged back, or otherwise invalidated, we may remove AI Uses that remain available and are associated with the invalidated purchase, subject to applicable law.

We do not reduce your available AI Use balance below zero.

Accordingly, the handling of a refunded or otherwise invalidated purchase may reduce available AI Uses but will not create a negative AI Use balance.

8.5 No transfer between accounts

AI Uses are associated with the account to which they were granted.

AI Uses cannot be transferred, sold, gifted, exchanged, or moved between Capigo accounts unless we explicitly introduce such functionality.

8.6 No cash value

AI Uses are a limited in-app usage entitlement and do not have cash value outside the App.

They are not currency, stored monetary value, or a financial instrument.

9. Free allowances and abuse prevention

Capigo may offer free AI Uses, introductory allowances, promotions, or other limited benefits.

Unless expressly stated otherwise, these offers are subject to reasonable anti-abuse measures.

You must not create or use multiple accounts, automated tools, false identities, or other methods primarily intended to circumvent eligibility limits or repeatedly obtain benefits that are intended to be limited.

We may refuse, suspend, or remove promotional benefits where we reasonably determine that an offer has been abused.

10. Reminders

Capigo may allow you to create reminders associated with notes.

10.1 Device and system requirements

Reminder functionality may depend on:

10.2 No guarantee of delivery

Although Capigo is designed to schedule reminders as accurately as reasonably possible, we cannot guarantee that every reminder will be delivered at the exact expected time or at all times.

Device restrictions, operating system behavior, missing permissions, battery-saving mechanisms, technical failures, or other circumstances outside our reasonable control may affect reminder delivery.

You should not rely on Capigo reminders for safety-critical, emergency, medical, legal, financial, or other time-sensitive purposes where failure to receive a reminder could cause significant harm.

11. Account deletion

You may request deletion of your Capigo account using the methods made available by us, including:

11.1 Server-side account data

Deleting your account removes or initiates the removal of the account data that is intended to be deleted as part of the account deletion process, subject to data that we are legally required or permitted to retain.

Details regarding personal-data retention are described in the Privacy Policy.

11.2 Unused AI Uses

Deleting your account permanently removes the account balance associated with that account.

Any unused AI Uses associated with the deleted account are permanently lost and cannot be recovered or transferred to another account.

Except where required by applicable law, unused AI Uses lost as a result of account deletion are not refundable.

11.3 Local data and multiple devices

Deleting an account does not necessarily delete local App data from every device.

Where account deletion is performed through the App, the App may delete applicable local data on the device on which the deletion process is performed.

Local notes, attachments, categories, settings, cached content, and other App data stored on other devices may remain on those devices until the user deletes the data or uninstalls the App.

Deleting an account through the website does not by itself delete local App data stored on your devices.

You are responsible for removing local data from devices where you no longer want it to remain.

12. Acceptable use

You must not use Capigo to:

We may take reasonable measures to protect the App, users, and our infrastructure against abuse.

13. Third-party services

Capigo relies on third-party platforms and services for certain functionality.

Depending on the feature used, these may include:

Third-party services may have their own terms, policies, availability limitations, and technical requirements.

We are not responsible for outages, interruptions, changes, or failures caused by third-party services outside our reasonable control.

The use and processing of personal data by third-party service providers are described further in the Privacy Policy and may also be subject to the providers' own applicable terms and policies.

14. Feedback and support submissions

Capigo may provide mechanisms allowing you to submit feedback, bug reports, descriptions, screenshots, or other materials.

Screenshots or other attachments are submitted only when you voluntarily select them. Capigo does not automatically capture screenshots of your device.

You should review any material before submitting it.

Do not submit information that you are not authorized to share.

If you choose to submit screenshots or other attachments, those materials may contain personal or sensitive information visible within the submitted content.

You are responsible for deciding what information you include in a submission.

We may use submitted feedback and technical information to investigate problems, provide support, and improve Capigo.

Attachments submitted through the feedback process are stored in private storage and are automatically deleted 30 days after submission.

15. News and external links

Capigo may display news, announcements, updates, or other informational content.

When the App checks for such content, it may connect to our infrastructure to retrieve a file containing information intended for the App. The same content may be provided to multiple users and is not personalized based on the content of your notes.

The App does not intentionally include your note content or account identifier in the request used to retrieve such content. However, as with ordinary internet requests, network infrastructure may process technical information such as an IP address and standard device or system request headers.

Downloaded news or update content may be stored temporarily in the App's private local storage and replaced when newer content is retrieved.

News or informational content may contain links to external websites.

If you choose to open an external link, you will leave the App and may be subject to the terms, privacy policy, and other rules of the external website or service.

We are not responsible for the content, availability, security, or practices of third-party websites that we do not control.

16. Intellectual property

The App, including its software, interface, design, branding, and other materials provided by us, is protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the App for its intended purpose.

You must not:

You retain ownership of the content you create and store on your device, subject to the rights necessary for third-party providers to process content when you voluntarily use features requiring such processing.

17. Availability and changes to the App

We may update, modify, add, remove, suspend, or discontinue features of Capigo.

We will not intentionally make changes that unlawfully deprive consumers of rights that apply to them.

18. Disclaimers

To the maximum extent permitted by applicable law, Capigo is provided on an "as available" basis.

We do not guarantee that:

Nothing in these Terms excludes guarantees, remedies, or consumer rights that cannot lawfully be excluded or limited.

19. Limitation of liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Subject to the preceding sentence, we are not liable for indirect or consequential losses arising from the use of the App, including loss of profits, business interruption, or loss of data, except where liability cannot lawfully be excluded.

You should maintain backups of important information where appropriate.

Nothing in this section affects mandatory consumer rights.

20. Suspension or termination

We may suspend or restrict access to all or part of Capigo where reasonably necessary to:

21. Changes to these Terms

We may update these Terms from time to time.

When we make material changes, we will provide notice where reasonably required by applicable law.

The "Last updated" date indicates when these Terms were most recently revised.

If a change requires your acceptance under applicable law, we will request that acceptance before applying the change where necessary.

Continued use of the App after an updated version becomes effective may constitute acceptance where permitted by applicable law.

22. Governing law and consumer protection

These Terms are governed by the laws of Poland.

If you are a consumer, nothing in these Terms deprives you of protection afforded by mandatory provisions of the law of your country of habitual residence where such provisions apply.

Nothing in these Terms limits your right to bring a complaint or pursue a remedy before a court or authority where such right is granted by applicable law.

23. Language versions

These Terms may be made available in languages other than English for convenience.

In the event of any inconsistency or difference in interpretation between the English version and a translated version of these Terms, the English version shall prevail, to the extent permitted by applicable law.
